Si liber homo in alia civitatem scandalum incitare praesumpserit et non percusserit, sit culpabiles in palatio regis solidos sex. Si autem percusserit aut plagaverit, sit culpabiles in palatium regis solidos duodicem, excepto conpositionis plagarum aut feritas si fecerit, sicut in hoc edictum legitur, conponat. |
Translation |
If a freeman dares to create a disturbance in another district but does not strike a blow shall pay six solidi to the king’s palace. If he does, however, strike a blow he shall pay twelve solidi to the king’s palace in addition to paying composition for the wounds or injuries that he inflicted as provided in this code.

Summary |
Rothari, No. 39 establishes a six solidi composition payable to the royal palace (i.e. royal fisc) for any free man who causes a disturbance in a city/district [civitatas] where the king is not present and where they do not strike a blow, but a composition of twelve solidi if they do strike a blow. In addition, they must also pay composition for any wounds inflicted. |
