Translation |
If any free man or enslaved man tries to flee the provincia [country]m and a judge or other resident within the boundaries of our provincia [country] apprehends him, he should hold him and keep safe the property which he carried with him. The apprehender should immediately send notice to the judge of the place from which the fugitive had fled in order that he may claim him, and he shall pay two solidi for a fugitive, in order that he and the properties that he took with him may be returned….

Summary |
Rothari, No. 264 addresses the situation when a free or enslaved fugitive is trying to escape the provincia [state], and has already made it into territory overseen by a different judge [iudex] before being caught. The law details how the caught fugitive(s) should be returned to the original judge (for a fee of 2 solidi each), and then goes on to address situations if, e.g. the fugitive manages to escape again, is killed trying, etc. |
