… He who is to swear shall then have twelve nights in the case of those who are near-twenty-four nights for those who are at a distance somewhere in Tuscany or Austria-to seek another oathhelper whom he can put in the place of that one [who refused to swear], and he may thus provide the oath for which he had given pledges…

Summary |
Liutprand, No. 61 addresses the situation when an oathhelper withdraws from an oath, demanding that they must give their reasons – and the legal processes if they cannot or will not explain why – and then gives a time limit for the person who is to swear the oath to find a replacement oathhelper: twelve nights if they live near (i.e. in Neustria), or twenty-four nights if they live further away, in Austria or Tuscany. |
