Quotation De scrivis hox prospeximus ut qui cartola scribent sive as legem Langobardorum quoniam apertissima et pene omnibus nota est sive ad Romanorum non aliter faciat…
Translation In the case of scribes, we decree that those who prepare charters should write them either according to the law of the Lombards – which is well known to be open to all – or according to that of the Romans; they shall not do otherwise … (Emended from K. Fischer-Drew, trans., The Lombard Laws (1973), p. 183)
Summary Liutprand, No. 91 establishes composition equal to the scribe’s wergild [worth] if they write a charter that does not accord to Lombard Law or Roman Law. The law also states that Lombard law is universal, and is available to all. The laws concludes by allowing that binding agreements between individuals can be made which go outside of either law, as long as it does not pertain to inheritance.
