Translation If any agreement is reached between fellow freemen or relatives, and three or four good men are present as witnesses, the agreement may not be denied later … If indeed an obligation has been made and pledges given and controversy has arisen on account of this, it shall be adjudicated afterwards as is read in an earlier law established by the most glorious King Rothari. Summary Liutprand, No. 8 establishes that agreements made between fellow freemen (conlibertus) or family (parentis) in the presence of three or four good men (homines boni) should not be denied. It then continues to define good men, and the legal process to be followed should it be believed that they have attempted to conceal the truth. The law then concludes by providing a cross-reference to the laws of Rothari, wherethe legal process for adjucation when there is some controversy is detailed.
