Translation If anyone travels within the country or outside the country for the purpose of carrying on any business or any craft whatever. If he does not return within three years because some illness has befallen him, he should make it known to his judge or his agent… (Emended from K. Fischer-Drew, trans., The Lombard Laws (1973), p. 152)
Summary Liutprand, No. 18 establishes a situation where a person (typically a merchant or craftsman) can effectively be declared dead, at least for legal purposes, if he has been travelling either within or beyond the country for more then three years and has not informed his judge [iudex] or another agent [missam] in that time. The law then allows for his property to be inherited (and details cirucsmtnaces should he return later), and for his wife to remarry with royal permission.
