Omnes waregang qui de exteras fines in regni nostri finibus advenerit seque sub scuto potestatis nostrae subdederint, legibus nostri langobardorum vivere debeant, nisi si aliam legem ad pietatem nostram meruerint. Si filius legetimus habuerint, heredes eorum existant sicut ad filii langobardorum; si filius legetimus non habuerint, nonsit illis potestas absque iussionem regis res suis cuicumque thingare aut per quolibet titulo alienare. |
| Translation |
All waregang [foreigners] who come from outside our frontiers into the boundaries of our kingdom and yield to the jurisdiction of our power ought to live according to the Lombard laws, unless through our grace they have merited another law. If they have legitimate children, these heirs shall live just as do the children of Lombards. If they do not have legitimate children, it shall not be in their power to give away any of their property or to alienate it by any means without the king's consent.

| Summary |
Rothari, No. 367 establishes the legal status of foreigners [waregang] who come within the borders [finibus] of “our kingdom” [regni nostri]. The normal situation is that they should then live by the Lombard law, unless the king grants them permsision to live under another law, and if they have legitimate heirs then they should also live as the children of other Lombards do. If they do not have heirs, then royal permission is required for the newcomer to transfer or alienate their property. |
